  • Other Service-Related Information: Depending on the services you engage with, we may collect additional information such as reference details, feedback, and post-hire follow-up information. The specific data collected will be detailed in the relevant service agreement or consent form.

We do not collect sensitive personal data such as ethnic origin, religious beliefs, or health information.

For Clients:

  • Business Contact Information: The name of your company, the name of the contact person, email address, and phone number.
  • Service-Related Information: Information about your job openings, candidate requirements, organizational culture, and other business information necessary for us to provide our Services. The specific data collected will be detailed in the relevant service agreement.

For Website Visitors:

  • Usage Data: We may collect information about how you use our website, such as your IP address, browser type, and the pages you visit.   • To Provide Our Services: We use Candidate and Client information to provide recruitment and advisory services as detailed in our service agreements.
  • Communication: We use your contact information to communicate with you about our Services, schedule interviews, and provide updates.
  • To Improve Our Services: We may use feedback from Candidates and Clients to improve the quality of our services.
  • Marketing: With your explicit consent, we may use your comments or feedback for marketing purposes. We may also contact potential Clients to introduce our services, and you will always have the option to opt-out of future communications.

4. Legal Basis for Processing Your Information

Under the GDPR, we rely on the following legal bases to process your personal data:

  • Consent: We process your personal data based on your explicit consent, which we will obtain from you in writing before providing our services or sharing your data in ways not covered by a service agreement.
  • Contract: We process your personal data when it is necessary for the performance of a contract with you, such as a service agreement with a Client or a career consultation agreement with a Candidate.
  • Legitimate Interest: We may process your data for our legitimate business interests, such as improving our services or contacting potential clients, provided that your rights and interests do not override our interests.

5. Data Sharing and Disclosure

We do not sell your personal information. We only share your data in the following circumstances:

  • With Clients: With your consent, we share Candidate information with our Clients for recruitment purposes.
  • Internally: Your information is shared with our internal team members for the purpose of providing our Services.
  • With Third-Party Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as our legal and accounting advisors, email providers, and communication tools. We have contracts in place with these providers to ensure they protect your data.

As a global company, we may transfer your personal data to countries outside of the European Economic Area (EEA), including to our clients in the United States. These Terms and Conditions ("Terms") are applicable to every legal relationship between SIA "Talent Unfolds" and you which is related directly or indirectly to this website and the services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

1. Definitions

In these Terms, the following definitions apply:

  • "Company," "we," "us," or "our" refers to SIA "Talent Unfolds," a company registered in the Republic of Latvia with registration number 40203658857 and registered address at Kraslavas Street 7B-13, Riga, LV-1003.
  • "Client" refers to any individual or entity that engages our services.
  • "Candidate" refers to any individual who provides us with their personal information for recruitment or career consultation purposes.
  • "Services" refers to the talent recruitment, advisory, and career consultation services offered by the Company.
  • "Work Product" refers to any materials, documents, reports, or other deliverables created by the Company for a Client in the course of providing the Services.

2. Scope and Standard of Services

Talent Unfolds provides a range of talent acquisition and advisory services. The specific scope of services for each engagement, including deliverables and timelines, will be detailed in a separate written service agreement between the Company and the Client.

We shall perform all Services with promptness, diligence, and in a professional manner, consistent with the standards of care, skill, and competence ordinarily exercised by service providers with comparable qualifications and expertise. We will comply with all applicable laws, rules, and regulations in the course of performing the Services.

3. User and Company Representations

By using our Services, you represent and warrant that:

  • For all users: Any information you provide to us is accurate, complete, and not misleading.
  • For Candidates: You have the legal right to work in the jurisdiction for which you are seeking employment, and the information in your CV and other application materials is truthful.
  • For Clients: You have the full right and authority to enter into an agreement with us for the provision of Services.

We represent and warrant that we are engaged as an independent contractor and not as an employee, agent, or partner of the Client, and nothing in these Terms or any service agreement shall be construed to create such a relationship.

4. Intellectual Property Rights

All rights, title, and interest in and to any Work Product developed in connection with the performance of our Services for a Client shall be the sole and exclusive property of the Client upon full payment for the Services. The Company shall have no rights of any kind in such Work Product and will not make any unauthorized use of it without the Client’s prior written consent.

Notwithstanding the foregoing, the Company retains all rights to its proprietary methodologies, tools, and processes used in the course of providing the Services. The content on our website, including text, graphics, logos, and images, is the property of Talent Unfolds and is protected by copyright and other intellectual property laws.

5. Confidentiality

We are committed to maintaining the confidentiality of all information shared with us by our Clients and Candidates. We will not disclose any confidential information to third parties without prior written consent, except as required by law or as necessary to provide our Services. These confidentiality obligations shall survive the termination of any agreement.

In some cases, we may require the execution of a separate non-disclosure agreement (NDA) which will prevail in the event of any inconsistency with these Terms. Upon termination of our services, we will return or destroy all confidential information as requested by the Client.

6. Privacy and Data Protection

We are committed to protecting your privacy and handling your personal data in accordance with applicable data protection laws. For detailed information about how we collect, use, store, and protect your personal information, please refer to our separate Privacy Policy. By using our website or engaging our Services, you acknowledge that you have read and understood our Privacy Policy.

7. Service-Specific Terms, Guarantees, and Payments

All terms specific to a particular service engagement – including but not limited to service guarantees, payment schedules, late fees, and non-solicitation clauses – will be detailed in the individual service agreement signed between Talent Unfolds and the Client. The service agreement is the governing document for all service-specific terms and conditions.

8. Disclaimers and Limitation of Liability

Our Services are provided with reasonable care and skill. However, we make no representation or warranty as to the success of any recruitment or consultation engagement. We do not guarantee that a Client will find a suitable candidate, nor that a Candidate will be successfully placed.

To the fullest extent permitted by law, Talent Unfolds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses. In no event shall the aggregate liability of Talent Unfolds for all claims relating to the Services exceed the amount of fees paid by the Client to the Company for the specific services from which the claim arose.

9. Indemnification

You agree to indemnify and hold harmless Talent Unfolds, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our Services or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms and any agreements for our Services shall be governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Latvia.

11. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders or any other force majeure event.

12. Termination and Survival

Agreements for our Services may be terminated by either party in accordance with the terms of the specific written service agreement. We reserve the right to suspend or terminate your access to our website at any time, without notice, for conduct that we believe violates these Terms.

The provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, confidentiality obligations, warranty disclaimers, indemnity, and limitations of liability.

13. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and any service agreement, constitute the entire agreement between you and Talent Unfolds.
  • Amendments: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.
  • Assignment and Subcontracting: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We reserve the right to assign our rights and obligations under these Terms and to subcontract our obligations with notice to you.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
  • Electronic Signatures: We may use electronic means to enter into agreements and your electronic signature will have the same legal effect as a handwritten signature.
